TERMS OF SERVICE

These Terms of Service (“Terms”) form a legal agreement between you and Mindflix Media Inc. (“Mindflix Media,” “we,” “us,” or “our”) and govern your use of:
- the website askdrmckenzie.com and any related sites we operate (collectively, the “Website”);
- the Ask Dr. McKenzie Community, hosted on a third-party platform (currently Bettermode) and any related groups, forums, or spaces (the “Community”); and
- any content, products, services, features, tools, events, or software we provide now or in the future (together with the Website and Community, the “Service”).
“You” and “your” refer to any person who visits the Website, creates an account, accesses the Community, or uses any part of the Service.
By clicking “I agree,” creating an account, or using any part of the Service, you are agreeing to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
We may update these Terms from time to time. When we do, we will change the “Last Updated” date above and may provide additional notice (for example, via email or an in-product message for material changes).
If you continue to use the Service after updated Terms are posted, you are agreeing to those changes. If you do not agree to the updated Terms, you must stop using the Service and, if applicable, close your account.
The Service is operated by Mindflix Media Inc., a corporation incorporated in Ontario, Canada.
Dr. McKenzie Goodine (“Dr. McKenzie”) provides educational and informational content through the Service. She does not provide therapy, clinical services, or individualized psychological treatment through the Service.
The Service may include, now or in the future:
- free or paid access to the Community where parents can submit questions, upvote questions, and post comments;
- a library of past video answers and related written content;
- downloadable materials or PDFs;
- online courses, workshops, memberships, live or virtual events, and training programs;
- software tools or applications (including, potentially, AI-powered tools); and
- newsletters, emails, podcasts, and social content embedded or linked from the Website.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
- Minimum age. The Service is intended for adults. You must be at least 18 years old and able to form a binding contract under applicable law to use the Service.
- Account registration. To access certain features (such as the Community or paid products), you may need to create an account and provide accurate, current information (for example, your name and email address). You agree to keep this information up to date.
- Account security. You are responsible for keeping your login credentials confidential and for any activity that occurs under your account. If you believe your account has been accessed without your permission, contact us at support@askdrmckenzie.com.
- One account per individual. We may restrict or close duplicate accounts created by the same person.
We collect, use, and disclose information about you as described in our Privacy Policy. This may include information such as your name, email address, user-submitted questions, comments, reactions or votes, analytics data, and any images or content you upload.
The Community is hosted by a third-party provider (currently Bettermode). Your use of the Community is also subject to Bettermode’s terms and privacy policy. We are not responsible for Bettermode’s (or any other third party’s) handling of your data.
The Service provides general educational information and guidance about parenting topics. It does not provide:
- mental health treatment;
- clinical assessment or diagnosis;
- psychotherapy or counselling;
- medical or psychological advice tailored to you or your child; or
- emergency or crisis services.
Your use of the Service does not create a psychologist-patient, therapist-client, or any other clinical or professional relationship between you and:
- Mindflix Media;
- Dr. McKenzie; or
- any other contributor, moderator, or staff member.
You are solely responsible for how you use the information obtained through the Service. Always seek the advice of a qualified health-care professional with questions about your child’s health or mental health. Never ignore or delay seeking professional help because of something you read, watch, or hear through the Service.
If you or your child are in crisis, experiencing thoughts of self-harm, or in any kind of emergency, do not use the Service. Call your local emergency number or seek immediate assistance from a qualified provider.
The Ask Dr. McKenzie Community is a space where parents can:
- submit questions about their child;
- upvote questions submitted by others;
- comment on questions to share experiences and support; and
- browse a searchable library of past questions and answers.
Dr. McKenzie chooses which questions to answer at her discretion, based on factors such as upvotes, fit with her expertise, and what may help the most parents. Answers are usually provided through public video content (for example, on social channels) and linked back to the Community’s “Past Answers” library.
By using the Community, you understand and agree that:
- There is no guarantee your question will be answered.
- Any response is general education for a broad audience, not personalized clinical advice.
- Other parents may respond to your posts and comments. These peer responses are not professional advice and we do not verify their accuracy.
- Older questions may be archived or closed to new submissions in order to keep the board manageable.
We may change how questions are collected, curated, or answered over time.
You agree that you will use the Service only for lawful purposes and in a respectful way. You must not:
- Use the Service to harass, threaten, abuse, or harm others, or to promote hate, discrimination, or violence.
- Post content that is obscene, sexually explicit, or otherwise inappropriate in a community focused on parents and children.
- Share names, addresses, schools, or other identifying details about your child, other children, or other users.
- Advertise or promote products, services, or other commercial activities without our prior written permission.
- Post spam, scams, chain letters, pyramid schemes, or bulk messages.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Upload viruses, malware, or any code intended to interfere with or damage the Service or other users’ devices.
- Attempt to gain unauthorized access to any systems, accounts, or data.
- Scrape, crawl, or systematically collect data from the Service without our express permission.
- Use the Service in any way that violates applicable laws or infringes any person’s rights, including privacy or intellectual property rights.
We reserve the right to decide, in our sole discretion, whether any content or behaviour violates these Terms or otherwise harms the community. We may remove content or restrict or terminate your access at any time (see Section 16).
“User Content” means any information, questions, comments, stories, images, videos, reactions, or other material that you submit, upload, post, or otherwise make available through the Service.
You are responsible for your User Content.
- Only share content you have the right to share.
- Do not post anything that infringes another person’s copyright, trademark, or other rights.
- If your User Content describes or includes another person, you are responsible for obtaining any necessary consent.
License to Mindflix Media.
- By submitting User Content, you grant Mindflix Media a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual license to use, reproduce, adapt, modify, translate, create derivative works from, publish, display, perform, and distribute that User Content in any media, for purposes connected with operating, marketing, improving, or explaining the Service.
- This includes, for example, using anonymous or de-identified versions of questions or comments in future content, courses, or materials.
Public nature of the Community.
- The Community is designed to be visible to other members, and in some cases, to the general public. Do not post anything you would not want others to see. We cannot control how other users may copy, share, or use content you choose to make public.
No obligation to use.
- We are not obligated to use any User Content and may remove or edit it at any time.
All content made available by Mindflix Media through the Service—such as videos, audio, text, images, graphics, logos, documents, software, and design elements—is owned by or licensed to Mindflix Media and protected by copyright and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to:
- access and use the Service; and
- view, stream, and download (where expressly enabled) our content solely for your personal, non-commercial use.
You must not:
- copy, reproduce, distribute, or publicly display our content except as allowed above;
- remove or alter any copyright, trademark, or other proprietary notices;
- resell, license, or otherwise exploit our content for commercial purposes; or
- reverse engineer or attempt to extract source code from any software we provide, except where allowed by law.
Community host.
- The Community is hosted by a third-party provider (currently Bettermode). Your use of the Community is subject to Bettermode’s own terms and policies, which may be presented when you create your account or log in. We are not responsible for Bettermode’s actions, outages, or handling of data.
Other third-party services.
- The Service may link or integrate with other platforms (for example, YouTube, Instagram, TikTok, Zoom, payment processors, or email tools). We do not control these services and are not responsible for their content or practices. Your use of third-party services is at your own risk and may be governed by different terms and privacy policies.
Affiliate or external products.
- From time to time we may reference or recommend third-party products or resources. This does not mean we endorse or guarantee them. Any purchase or use of third-party products is solely between you and that third party.
We may offer paid products and services, such as:
- online courses or programs;
- memberships or subscriptions;
- live or recorded workshops and events;
- books or other digital downloads;
- software or app-based tools.
Specific pricing, payment methods, renewal terms, refund policies, and product-specific rules will be described at the time of purchase, in checkout flows, or in separate terms that supplement these Terms (“Supplemental Terms”). If there is a conflict between these Terms and any Supplemental Terms for a particular product, the Supplemental Terms will govern for that product.
By purchasing or subscribing to a paid offering, you agree:
- to provide accurate payment information and authorize us and our payment processors to charge your chosen payment method;
- to the renewal and cancellation terms presented at checkout (for example, auto-renewing monthly or annually until you cancel); and
- that applicable taxes may be added to the price.
We may change prices or product offerings from time to time. Changes will not retroactively affect fees already paid for a current subscription term, but may apply to renewals.
We aim to provide high-quality, evidence-informed educational content. However, every child, family, and situation is different. We cannot promise that:
- your child’s mental health will improve;
- certain behaviors will change;
- a particular strategy will work for your family; or
- any specific outcome will occur.
You are responsible for deciding how to use the information provided and for seeking professional advice when needed.
To the fullest extent permitted by law, the Service and all content, information, and features are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory.
Without limiting the foregoing, we do not guarantee that:
- the Service will be uninterrupted, secure, or error-free;
- the information provided is complete, up-to-date, or suitable for your particular situation; or
- any defects will be corrected.
Any reliance you place on material obtained through the Service is at your own risk.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
To the maximum extent permitted by applicable law:
- Mindflix Media, Dr. McKenzie, our directors, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the Service; and
- our total aggregate liability for any claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) CAD $100 or (b) the total amount you have paid to us for paid offerings in the twelve (12) months prior to the event giving rise to the claim.
Nothing in these Terms is intended to exclude or limit liability that cannot be excluded or limited under applicable law (for example, certain rights under consumer protection statutes).
To the extent permitted by law, you agree to indemnify and hold harmless Mindflix Media, Dr. McKenzie, and our directors, officers, employees, contractors, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- your use or misuse of the Service;
- your User Content;
- your breach of these Terms or any applicable law; or
- your violation of any third party’s rights.
We may, at our own expense, assume the exclusive defense and control of any matter subject to indemnification. In that case, you agree to cooperate with our defence.
We may, at any time and in our sole discretion, suspend or terminate your access to all or part of the Service (including your Community account) without notice, including if we believe that:
- you have violated these Terms;
- your behavior is harmful to other users or to our brand;
- we need to do so to comply with law or protect our rights; or
- we are discontinuing the Service.
You may stop using the Service at any time and, where applicable, close your account. Some provisions of these Terms (for example, those relating to intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply even after your access ends.
We are not responsible for any loss of User Content resulting from suspension or termination. We recommend you keep your own copies of any content you wish to retain.
If you believe that content available through the Service infringes your copyright or other intellectual property rights, please contact us at support@askdrmckenzie.com with sufficient detail for us to locate the material and assess your request. We may remove or restrict access to content at our discretion.
The Service is operated from Ontario, Canada, but may be accessed by users around the world. You are responsible for complying with all laws that apply to you based on your location and circumstances.
We do not represent that the Service or any content is appropriate or available in every jurisdiction. We may restrict access from certain locations if required by law or for risk management.
These Terms and any dispute or claim arising out of or relating to them or the Service will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws rules.
You agree that any legal action or proceeding between you and Mindflix Media relating to the Service or these Terms will be brought exclusively in the courts of the Province of Ontario, and you submit to the personal jurisdiction of those courts.
Where permitted by law, you and Mindflix Media each agree to bring claims only in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
We may modify, suspend, or discontinue any part of the Service, or introduce new features or impose limits, at any time. We will not be liable to you or any third party for any modification, suspension, or discontinuation.
You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent. We may assign or transfer these Terms, in whole or in part, to any affiliate or in connection with a merger, sale of assets, or similar transaction without notice to you.

Notices sent by email will be deemed received when sent, provided they are sent to the most recent email address you have provided us.
- These Terms, together with any Supplemental Terms and our Privacy Policy, form the entire agreement between you and Mindflix Media regarding the Service and supersede any prior agreements or understandings.
- If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.
